Fees in the Employment Tribunal Introduced
Controversially, any employee or ex-employee wishing to present a claim to the Employment Tribunal on or after 29 July 2013 must now pay a fee depending on the type of claim as follows:

* Level 1 (unlawful deductions, payment in lieu, redundancy payments): £160 issue fee/ £230 hearing fee; and

* Level 2 (unfair dismissal, discrimination, other claims): £250 issue fee/ £950 hearing fee.

In relation to appeals, there will be a £400 issue fee and a £1,200 hearing fee.

Tribunals will have the power to order the unsuccessful party to reimburse fees paid by the successful party. The sanction for the non-payment of an issue fee or hearing fee is that the claim will not be allowed to commence or continue. However, the introduction of these fees has been challenged in the Courts with requests for a Judicial Review on the grounds of indirect discrimination. An interim injunction was refused and a full hearing is expected to take place in October 2013. In the meantime the fees remain payable.
