Change to Collective Redundancy Consultation Period
The government has announced changes to the minimum period for collective redundancy consultations where more than 100 redundancies are proposed. Large scale redundancies will now require a 45-day consultation period (a reduction from the current period of 90 days). This new 45-day period will come into force from April 2013.

This change does not affect the consultation period for collective redundancies of 99 employees or fewer at one establishment - or redundancies of individual posts.

Note that in addition, fixed-term contracts which reach their agreed termination date will be exempted from the collective redundancy consultation obligations (but you should still consult with the employees affected on an individual basis.)

ACAS will produce non-statutory guidance to address “key contentious issues”, aiming to promote good-quality redundancy consultation between employers and employees.
