Loss of Working Time Opt Out – Ruled Out
Following the breakdown in negotiations between the Council of Ministers and the European Parliament, the review of the Working Time Directive is over and the UK’s individual opt-out of the 48 hour week remains.

The final meeting of the Conciliation Committee trying to resolve the differences between the Council of Ministers and the European Parliament on the review of the Working Time Directive have broken down after lengthy negotiations. As a result, the proposed review of this Directive has ended and the current Working Time Directive remains in force.
This means that employers and their employees can continue to make use of the individual opt out from the average 48-hour week for the foreseeable future. It had previously been thought that this might disappear as a result of the review.
