I have had several enquiries from clients asking whether they can insist that employees must be vaccinated. Indeed, it has hit the headlines with Charlie Mullins, owner of Pimlico Plumbers who has been reported as saying that they will introduce a, “No jab. No job” policy. But is this legal and can you do the same?

Covid-19: When can we return to work?

We now have the Government’s route map to get the country back to normal from Covid-19 with the publication of its Spring Response. On 22nd February, The Prime Minister, Boris Johnson announced the plans to start to open up the economy. There will be several steps starting on the 8th March when most of the schools in England will reopen (different arrangements apply to the other Nations in the UK) and there is expected to be a gradual lifting of restrictions over the following months.

But this has started people asking when will it be OK to ask employees to return to work?

Uber Alles – The End of The Road!

It cannot have escaped your notice that Uber recently lost its latest appeal case in the UK’s Supreme court and the Judge confirmed earlier findings that its drivers were not self-employed but were “workers” for the purposes of employment law.

The original case was brought in 2016 and has since been heard in the Employment Appeal Tribunal and the Court of Appeal. Each time the rulings went against Uber and they have now reached the end of the road. This case has far-reaching implications for many businesses.

Shielding Extensions – time and numbers

Employers will have found that staff who had previously been told to “shield” were notified on 15th February that their shielding period should be extended until the end of March. Whilst this is advisory, many employers are insisting that such employees should not come into the workplace.

And then a couple of days later 1.7 million people were added to the shielding list. This has almost doubled the number of people affected after a new risk assessment model was adopted by the NHS.

Some Furlough Updates: Treasury Direction & Company Names

Since the last newsletter there have been a couple of updates with regards to the furlough scheme and how it is applied.

Firstly, the Treasury has issued a new Direction to HMRC regarding the rules of payment from 1st February to the 30th April 2021.
