All care home workers will be required to be fully vaccinated against Covid-19 from 11 November 2021, unless they are medically exempt under the regulations. The new guidance covers anyone entering to undertake care work.
Workers must have received the full course of the vaccination and in England will need to show their proof of vaccination status either via the NHS app, or through the NHS website or by an official NHS COVID Pass letter.
The regulations also apply to third parties entering the care homes (although only working outside will not be required to be vaccinated.)
If you run a care home and have employees who are refusing to be vaccinated (but are not covered by the medical exemptions) then you may need to terminate their employment on the grounds of failure to comply with a legal requirement (this would be classified as “Some Other Substantial Reason”) but you should still go through a fair process before taking this step in case you can persuade the employee to change their mind or find work for them outside the home.
